{"id":7045,"date":"2023-07-26T13:38:25","date_gmt":"2023-07-26T13:38:25","guid":{"rendered":"https:\/\/www.childrenscommissioner.gov.uk\/imo\/?p=7045"},"modified":"2023-07-26T13:38:29","modified_gmt":"2023-07-26T13:38:29","slug":"have-your-say-should-care-experience-be-a-protected-characteristic","status":"publish","type":"post","link":"https:\/\/www.childrenscommissioner.gov.uk\/imo\/other-opportunities\/have-your-say-should-care-experience-be-a-protected-characteristic\/","title":{"rendered":"Have your say &#8211; should care experience be a protected characteristic?"},"content":{"rendered":"\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h2 class=\"wp-block-heading\">The Children\u2019s Commissioner, Dame Rachel de Souza, wants to hear your views on whether care experience should be made a protected characteristic.<\/h2>\n\n\n\n<p>A protected characteristic means it&#8217;s against the law to discriminate anyone because of their:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>age;<\/li>\n\n\n\n<li>gender reassignment;<\/li>\n\n\n\n<li>being married or in a civil partnership;<\/li>\n\n\n\n<li>being pregnant or on maternity leave;<\/li>\n\n\n\n<li>Disability;<\/li>\n\n\n\n<li>race including colour, nationality, ethnic or national origin;<\/li>\n\n\n\n<li>religion or belief;<\/li>\n\n\n\n<li>Sex; and<\/li>\n\n\n\n<li>sexual orientation.<\/li>\n<\/ul>\n\n\n\n<p>Making \u2018care experience\u2019 a protected characteristic would mean that people who are in or have been in care would have the same legal protection against discrimination as ten other characteristics under the equality act.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>Here is the blog that the Children\u2019s Commissioner has shared:<\/strong><\/h6>\n\n\n\n<p>I want every child in care and care experienced person to be able to achieve all their ambitions. People who have interacted with the care system have often had the hardest start in life, so it is up to all of us in positions of responsibility to ensure that nothing holds them back.<\/p>\n\n\n\n<p>That is why I have set out my vision for care leavers, carried out research on children in care maintaining relationships with their siblings, examined the education of looked after children and it\u2019s why I sit on the implementation board for the current reforms to children\u2019s social care.<\/p>\n\n\n\n<p>I established my own Care Experienced Advisory Board to make sure that the voices of children in care and care experienced people are central to all of my work. My team and I regularly visit children in care in a range of settings across the country to make sure their voices are heard and their rights are upheld.<\/p>\n\n\n\n<p>I want to explore every possible avenue for ensuring that all the barriers that care experienced people face to achieving their ambitions are removed. One debate that is currently taking place is about whether care experience should be a \u2018protected characteristic\u2019 \u2013 like age, disability or religion currently are. You can read more here about what a \u2018protected <a href=\"https:\/\/www.gov.uk\/discrimination-your-rights\">characteristic\u2019<\/a> is. Some people I have spoken to argue that this would provide a way to tackle the discrimination care experienced people face, while others suggest that it could create additional stigma, or simply not be effective. But I don\u2019t want this to be a debate that is held about care experienced people, rather than with them \u2013 as is too often the case.<\/p>\n\n\n\n<p>That is why I am today launching an opportunity for care experienced people to tell me what they think about this proposal \u2013 whether they believe it would make a difference to their lives, or not, and why. I will read all these ideas and want this to be the start of a rich conversation.<\/p>\n\n\n\n<p>To all care experienced people and children in care \u2013 please share your views.
